Terms of Service

These Terms of Service ("Terms") govern your use of the AISWise platform and services. By creating an account or using our services, you agree to these Terms.

Definitions

  • "Platform": the AISWise web application, API, and chat widget
  • "Client": a registered user who configures and manages AI chatbot agents
  • "End User": a visitor who interacts with a Client's chat widget
  • "Service": the AI-powered chatbot platform provided by AISWise

Account and Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your credentials
  • You must be at least 18 years old or have legal capacity to enter into contracts
  • One account per organization; sharing credentials is prohibited

Service Description

AISWise provides an AI-powered chatbot platform that enables Clients to deploy conversational agents on their websites. The service includes:

  • AI chatbot widget embeddable on any website
  • Dashboard for managing conversations, FAQs, leads, and analytics
  • Customization tools for widget appearance and behavior
  • Lead capture and contact management
  • Multi-language support

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Collect personal data without proper consent or legal basis
  • Distribute malicious, harmful, or illegal content through the chatbot
  • Attempt to circumvent security measures or rate limits
  • Impersonate other users or organizations
  • Use the AI to generate content that is discriminatory, defamatory, or harmful

Data Ownership and Processing

  • Clients retain ownership of their business data and chatbot configurations
  • End User conversation data is processed on behalf of the Client (data processor)
  • AISWise does not use conversation data to train AI models
  • Clients are responsible for informing their End Users about data collection

AI Disclosure (EU AI Act)

In compliance with the European AI Act:

  • End Users are informed that they are interacting with an AI system
  • The chatbot clearly identifies itself as an AI assistant
  • Conversation logs are available for human oversight
  • The system includes a guardrail mechanism to prevent harmful outputs
  • Clients can review and manage all AI-generated responses

Service Tiers and Limitations

  • Free: limited message quota per month, basic features
  • Pro: higher message quota, advanced features, priority support
  • Enterprise: custom limits, dedicated support, SLA
  • Message quotas reset monthly; unused messages do not carry over

Limitation of Liability

To the maximum extent permitted by law:

  • AISWise provides the Service "as is" without warranties of any kind
  • We are not liable for AI-generated responses or their consequences
  • Our total liability is limited to the fees paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages

Termination

  • Clients may delete their account and data at any time
  • AISWise may suspend accounts that violate these Terms
  • Upon termination, conversation data is retained for 30 days, then permanently deleted
  • Business data and configurations are deleted immediately upon account deletion

Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Barcelona, Spain.

Changes to Terms

We may modify these Terms with 30 days' notice to registered Clients. Continued use of the Service after changes take effect constitutes acceptance.
